Terms of Service

Article 1 Purpose These Terms of Service aim to stipulate various conditions and operations regarding the use of the "Hello Donggu" (hereinafter referred to as "App") service. Article 2 Definitions The key terms used in these Terms of Service are defined as follows: Member: A person who agrees to the app's terms, provides personal information, registers as a member, enters into a usage contract with the app, and uses the app. Usage Contract: The contract formed between the app and a member regarding the use of the app. Member ID (hereinafter referred to as "ID"): A unique combination of characters and numbers assigned to each member for member identification and service use. Password: A combination of characters and numbers chosen by the member to verify the member's identity and protect the member's rights. Operator: The person who establishes and operates the service website. Termination: The cancellation of the usage contract by the member. Article 3 Supplementary Provisions The operator may provide separate operational policies if necessary, and these policies will take precedence if they overlap with these terms. Article 4 Formation of the Usage Contract The usage contract is established by the operator's acceptance of the membership application and the applicant's agreement to these terms. Those wishing to register as members and use the service must read these terms and indicate their agreement by selecting "I agree" during the sign-up process. Article 5 Application for Service Use Applicants must provide all requested information (e.g., user ID, password, nickname) to register as members. Members who register false or another person's information will not have any rights regarding the app and may be subject to legal consequences. Article 6 Privacy Policy The app and operator do not hold passwords provided during registration and adhere to the app's privacy policy regarding this matter. The operator strives to protect members' personal information as required by law. The protection of members' personal information follows relevant laws and the app's privacy policy. However, the operator is not responsible for information exposed due to the member's fault. The operator may inspect and submit a member's data to relevant authorities upon request if the member posts or distributes illegal content. Article 7 Operator's Obligations The operator must promptly address legitimate opinions or complaints from members. If immediate resolution is difficult, the operator will notify the member of the delay through notices, messages, or email. To ensure continuous and stable service, the operator must promptly repair or restore facilities if they become damaged or lost. However, the app operation may be temporarily suspended due to unavoidable circumstances like natural disasters or other reasons. Article 8 Member's Obligations Members must comply with these terms, the app's policies, notices, and relevant laws, and must not interfere with the app's operations or damage its reputation. Members cannot transfer or provide their service usage rights or usage contract status to others without explicit consent from the app. Members must manage their ID and password diligently and cannot allow third parties to use them without the operator's consent. Members must not infringe on the intellectual property rights of the operator, the app, or third parties. Article 9 Service Usage Time The service is available 24/7, unless there are special circumstances or technical issues. However, the app may temporarily suspend services for scheduled maintenance, expansion, or replacement, with prior notice posted on the app's website. The app may suspend services without prior notice for urgent maintenance, expansion, replacement, malfunction, or operation issues, in case of national emergencies, power outages, natural disasters, or other unavoidable circumstances, or if a telecommunications carrier suspends services. In such cases, the app will notify members through notices, and if prior notice is not possible, post a notice afterward. Article 10 Termination of Service Use To terminate the usage contract, members must submit a termination request online. Separately, they must also terminate their contract with the app. Upon termination, the app's related programs are automatically deleted from the member's management screen, and the operator will no longer have access to the member's information. Article 11 Service Use Restrictions The app may restrict or suspend a member's service use or terminate the usage contract for actions such as registering false information, obstructing others' use of the app, impersonating the app's staff, infringing on the rights of the app or third parties, using another member's ID improperly, collecting personal information without consent, engaging in criminal activities, or violating relevant laws. Article 12 Management of Posts The operator is responsible for managing and operating the app's posts and materials, must monitor for and delete inappropriate content, and warn the posting member. Members are responsible for their posts and must not post content that violates these terms. The operator may delete or move posts without prior consent from the member if requested by public institutions. Inappropriate posts include content that insults or damages others' reputation, violates public order or morals, promotes illegal copying or hacking, is for commercial purposes, is objectively linked to criminal activities, infringes on others' rights, or violates relevant laws. The app and operator may temporarily suspend posts if requested for reasons like defamation or intellectual property infringement, following decisions from relevant institutions. Article 13 Storage of Posts If the operator must discontinue the app due to unavoidable circumstances, members will be notified in advance and all measures will be taken to facilitate the transfer of posts. Article 14 Copyright of Posts The copyright of posts on the app belongs to the member who posted them. The app cannot use posts for commercial purposes without the member's consent, except for non-commercial purposes and for posting within the service. Members cannot commercially use information obtained through the service or the materials posted on the app. The operator may delete, move, or reject posts without prior notice if they violate Article 12. Article 15 Compensation for Damages Members are primarily responsible for all civil and criminal liabilities arising from their use of the app. The app is not liable for damages caused by unavoidable circumstances like natural disasters or the member's intentional or negligent acts. Article 16 Disclaimer The operator is not responsible for members' failure to obtain the expected benefits from the service or for damages from the selection or use of service materials. The operator is not responsible for service disruptions due to issues with the telecommunications services provided by carriers, and the terms of the usage contract apply to damages related to the app's service foundation. The operator is not responsible for materials stored, posted, or transmitted by members. The operator is not liable for service use disruptions caused by members' actions. The operator is not responsible for any activities between members or between members and third parties. The operator is not liable for the content's authenticity, reliability, or accuracy of materials posted or transmitted by members. The operator is not responsible for damages arising from transactions conducted through the service between members or between members and third parties. The operator is not responsible for disputes between members or between members and third parties without the operator's fault. The operator is not responsible for system disruptions, third-party attacks, or other uncontrollable events causing damages to members. Supplementary Provisions These terms are effective from July 1, 2024.
